On January 23, 2012, Defendants filed a notice with the Colorado Supreme Court that they will be appealing five orders of the district court in Lobato, including the ruling that Colorado’s school finance system violates the state constitution. In their notice, Defendants raise twelve potential issues for appeal, including several issues that have been previously argued and lost in the Supreme Court. All of the State’s bases for appeal are technical, legal arguments that do not speak to whether students are getting a constitutionally adequate education.
